Relatório Com fundamento em violação da sua posse por parte da penhora, A... deduziu embargos de terceiro a essa penhora efectuada numa execução fiscal promovida pela Caixa Geral de Depósitos para cobrança coerciva de uma dívida contratual do marido da embargante.
Por sentença de fls. 98 e seguintes, o Tribunal Tributário de Leiria julgou os embargos procedentes e levantou a penhora do prédio e a sua restituição à posse da embargante.
Esta sentença foi notificada à Fazenda Pública mas não à Caixa Geral de Depósitos.
Quando teve conhecimento da sentença, a CGD veio arguir a nulidade da falta de notificação da sentença - o que só ocorreu mais de dois anos após a data da sentença - alegando que tinha de ser notificada por ser interessada na sentença.
Por despacho de fls. 132 e 133, o Tribunal Tributário de Leiria indeferiu a arguição de nulidade de processo por ter entendido que a CGD não tinha de ser notificada da sentença, pois quem é o exequente é o Estado através da DGCI.
Não se conformando com este despacho, dele recorreu a CGD para este STA, tendo apresentado as suas alegações de fls. 136, nas quais concluiu que é a CGD que detém legitimidade para ser notificada; que há regras especiais sobre legitimidade da CGD; que constituiu mandatário no processo, pelo que este tinha de ser notificado da sentença; que a falta de notificação da sentença é nulidade insuprível e que é nulo todo o processo subsequente à omissão da notificação.
Não houve contra-alegações.
Neste STA, o MºPº emitiu douto parecer nos termos do qual se deve conceder provimento ao recurso.
Corridos os vistos cumpre decidir a questão de saber se a decisão recorrida deve ser confirmada ou reformada.

Fundamentos Para decidir como decidiu, o Mº Juiz a quo fundou-se no disposto no artº 238º do CPT, nos termos do qual "tem legitimidade para promover a execução das dívidas referidas no artº 233º o Estado, através da Direcção-Geral das Contribuições e Impostos".
Como tal, exequente seria o Estado, representado pela DGCI, e não a CGD.
As dívidas civis à CGD cabem na execução fiscal como dívidas equiparadas por lei aos créditos do Estado - artº 233º, nº 2, al. b), do CPT. Este sistema só terminou com o actual estatuto da CGD, aprovado pelo DL 287/93, de 20 de Agosto. A dívida em execução é anterior a essa data.
Tem sido jurisprudência uniforme deste STA que as dívidas de direito civil cobradas coercivamente em processo de execução fiscal não perdem a natureza de dívidas de direito...
